1.- Legal Notice and Information

The present legal notice and information (hereinafter, the “Legal Notice”) regulates the use of the Internet service www.avco.legal (hereinafter the “Website”) that AVCO Legal S.C. (hereinafter “AVCO”) makes available to Internet users.

AVCO is a civil partnership with registered office at Calle Velázquez 37, 1º, 28001, Madrid, Spain, with Tax Identification Number (C.I.F.) J-78870516.

2.- Purpose

Through the Website, AVCO facilitates users’ access to and use of various services and contents made available to them by AVCO or by third parties.

3.- Conditions of Use and Acceptance

Access to and use of this Website attributes the condition of user and implies full acceptance by the user of these conditions of use, as well as those particular conditions established for certain services that will complement these. The user commits to using the Website and the services in accordance with the law, this Legal Notice, the particular conditions of certain services, and other notices, regulations, and instructions made known to them, as well as generally accepted morals, good customs, and public order.

The pages of www.avco.legal may be visited freely by users, excluding those located in closed areas, or those that require registration in a user registry, which implies the completion of the corresponding user registration, to be carried out in the manner expressly indicated in the service itself or in the Particular Conditions regulating it.

All information provided by the user through the services must be truthful. For these purposes, the user guarantees the authenticity of all data communicated as a consequence of the use of certain services. Likewise, it will be the user’s responsibility to keep all information provided to AVCO permanently updated so that it responds, at all times, to the user’s real situation. AVCO shall not be liable for any damages that may be caused to third parties by the information provided.

To this end, the user shall refrain from using any of the services for illicit purposes or effects, prohibited in this Legal Notice, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, deteriorate, or prevent the normal use of the services, computer equipment, or documents, files, and all kinds of content stored on any computer equipment (“hacking”) of AVCO, other users, or any Internet user (hardware and software).

In particular, and merely for guidance and not limitation, the user agrees not to transmit, disseminate, or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, and, in general, any kind of material that:

  • in any way is contrary to, disparages, or infringes upon fundamental rights and public freedoms recognized constitutionally, in international Treaties, and in the rest of the legislation;
  • induces, incites, or promotes criminal, denigrating, defamatory, infamous, violent acts, or in general, acts contrary to the law, morals, generally accepted good customs, or public order;
  • induces, incites, or promotes discriminatory actions, attitudes, or thoughts based on sex, race, religion, beliefs, age, or condition;
  • incorporates, makes available, or allows access to criminal, violent, offensive, harmful, degrading products, elements, messages, and/or services, or in general, contrary to the law, morals, generally accepted good customs, or public order;
  • induces or may induce an unacceptable state of anxiety or fear;
  • induces or incites involvement in dangerous, risky, or harmful practices for health and psychological balance;
  • is false, ambiguous, inaccurate, exaggerated, or untimely, in such a way that it induces or may induce error regarding its object or the intentions or purposes of the communicator;
  • is protected by any intellectual or industrial property rights belonging to third parties, without the user having previously obtained from their holders the necessary authorization to carry out the use they effect or intend to effect;
  • violates the trade secrets of third parties;
  • is contrary to the right to honor, personal and family privacy, or the person’s own image;
  • in any way impairs the credit of AVCO or third parties;
  • infringes regulations on the secrecy of communications;
  • constitutes, where applicable, illicit, misleading, or unfair advertising and, in general, constitutes unfair competition;
  • incorporates viruses or other physical or electronic elements that may damage or prevent the normal functioning of the network, the system, or computer equipment (hardware and software) of AVCO or third parties, or that may damage electronic documents and files stored on said computer equipment;
  • causes, due to its characteristics (such as format, extension, etc.), difficulties in the normal functioning of the service;
  • contains HTML tags different from those expressly authorized by AVCO.

The user commits to correctly using the contents made available on the Website, understanding by these, without this enumeration being limiting, the texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as their graphic design and source codes, in accordance with the law, this legal notice, the particular conditions of certain services, and other notices, regulations, use and instructions made known to them, as well as with morals and generally accepted good customs and public order, and in particular commits to abstaining from:

  • reproducing, copying, distributing, making available, or in any other way publicly communicating, transforming, or modifying the contents, unless authorized by the holder of the corresponding rights or it is legally permitted;
  • suppressing, manipulating, or in any other way altering the “copyright” and other identifying data of the reservation of rights of AVCO or its holders, of the digital fingerprints, or of any other technical means established for their recognition;
  • obtaining, and even attempting to obtain the contents using means or procedures other than those which, depending on the case, have been made available for this purpose, or have been indicated for this purpose on the web pages where the contents are located or, in general, those normally used on the Internet.

AVCO may delete any information or content capable of disrupting the functioning of the Website or that is contrary to national or international law in force.

4.- Introduction of Hyperlinks

Users, and all those persons who intend to establish a hyperlink between their web page or portal and the Website www.avco.legal, must comply with the following conditions:

  • The hyperlink will only allow access to the home page of the Website, but may not reproduce them in any form;
  • No frame will be created over the web pages of the Website;
  • No false, inaccurate, or incorrect statements or indications will be made about the web pages of the Website and the services supplied;
  • It will not be implied in any way that AVCO has authorized the hyperlink, or that it has assumed in any way the services offered or made available from the web page on which the hyperlink is established;
  • Except for those signs that form part of the hyperlink itself, the page on which the hyperlink is established will not contain any distinctive sign, of those recognized by current Legislation, of which AVCO is the holder, unless expressly authorized by it;
  • The web page on which the hyperlink is established will not contain contents contrary to any third-party rights, nor contain illicit information or contents, contrary to morals or generally accepted good customs and public order.

5.- Industrial and Intellectual Property

The entirety of the Website: text, images, trademarks, logos, audio and video files, buttons, software files, color combinations, as well as the structure, selection, arrangement, and presentation of its contents are the property of AVCO or third parties, and are protected by Spanish and international laws on industrial and intellectual property. Likewise, and without prejudice to the foregoing, the content of the Website is considered a computer program and all current Spanish and European Community regulations on the matter apply to it.

By accessing the Website, none of the exploitation rights that exist or may exist over said uses beyond those strictly necessary for the correct use of the Website can be understood as ceded to the user.

6.- Limitation of Liability

AVCO excludes, to the full extent permitted by law, any liability for damages of any nature that may be due to:

  • Presence of viruses, or the presence of other elements in the contents that may produce alterations in the computer system, electronic documents, or files of the users.
